Elon Musk says SpaceX will sue FAA for ‘regulatory overreach’

Elon Musk has announced that SpaceX will sue the Federal Aviation Administration (FAA) for what he describes as "regulatory overreach". This follows the FAA’s proposal to fine SpaceX over $630,000 for alleged violations during two 2023 launches. Musk claims that the FAA’s actions are politically motivated and improper.

The FAA cited issues such as using an unapproved launch control room and failing to conduct a pre-launch poll during a May 2023 launch, as well as using an unapproved rocket propellant farm in a July 2023 launch. Musk has criticized these penalties as excessive and has expressed frustration with the regulatory process.

  • SpaceX CEO Elon Musk said his rocket company plans to sue the Federal Aviation Administration for “regulatory overreach.”

  • Musk’s threat of litigation came after the FAA said it would levy fines against SpaceX over purported licensing and safety-related violations during two launches in 2023.

  • In a recent blog post, SpaceX complained about “difficulties launch companies face in the current regulatory environment,” specifically pertaining to “launch and reentry licensing.”

“NASA puts their faith in @SpaceX for all astronaut transport to and from the [International Space Station], but somehow [FAA] leadership thinks they know better,” he wrote in a post to his almost 200 million followers.

In another post, Musk said, “I am highly confident that discovery will show improper, politically-motivated behavior by the FAA.”

The FAA did not respond to CNBC’s request for comment.
